These Terms & Conditions apply to the AthleticsFit application (iOS, Android, web) and the website afmeals.com (the “App”). By using the App, you agree to these Terms. If you do not agree, you must stop using the App immediately.
We may update these Terms at any time. Continued use of the App constitutes acceptance of any changes.

REFUND POLICY
All sales are final. We do not accept food returns.
All sales are final once an order is prepared or delivered. Meals scheduled for delivery or pickup within 48 hours are non-refundable.
Orders may include multiple deliveries — refunds apply only to eligible items. Approved refunds are subject to a 3.00% non-refundable processing fee (minimum $1.95).
We may, but are not obligated to, issue refunds, credits, or replacements solely in cases of:
• Incorrect items
• Damaged meals
We do not issue refunds based on taste preferences or subjective dissatisfaction.
Unclaimed meals after 4 days will be discarded with no refund or credit.
DELIVERY POLICY
Schedule:
• Delivery: Sunday / Tuesday / Thursday (5 PM – 11 PM)
• Pickup: Sunday / Tuesday / Thursday (3 PM – 6 PM)

Delivery times are estimates and are not guaranteed.
We may delay, reschedule, or refuse delivery due to:
• Weather or unsafe conditions
• Incorrect address
• Outside delivery zones or times
DELIVERY DETAILS & CUSTOMER AVAILABILITY
You are responsible for being available to receive your order at the scheduled delivery time.
If you are not available at the time of delivery:
• The order may be left at your door or designated drop-off location at your request or at the driver’s discretion
• We may attempt to contact you via phone or SMS, but are not obligated to do so
• If we are unable to reach you or complete a hand-off, the delivery will still be considered completed
If you provide delivery instructions (including unattended delivery), you assume all risks including:
• Theft
• Damage
• Spoilage due to temperature exposure
• Environmental contamination
AthleticsFit is not responsible for any loss or damage after delivery is completed.
FAILED DELIVERY & INCORRECT INFORMATION
You are solely responsible for providing accurate delivery information.
If delivery cannot be completed due to:
• Incorrect or incomplete address
• Lack of access (gates, security, buildings)
• Customer unavailability
• Failure to respond
The order is considered fulfilled and non-refundable.
BUSINESS & THIRD-PARTY LOCATIONS
If delivering to a business or third-party location:
• You are responsible for ensuring delivery is allowed
• You must ensure someone can receive the order
We are not responsible for:
• Refused deliveries
• Limited access or business hours
• Loss after delivery
UNATTENDED DELIVERY CONDITIONS
Meals may be delivered in insulated packaging, but temperature retention is limited.
You agree that:
• You must retrieve your order promptly
• You must refrigerate immediately
• You assume all risks from delays or exposure
AthleticsFit is not responsible for spoilage or foodborne risks due to delayed handling.
DELIVERY RESPONSIBILITY (TRANSFER OF RISK)
Ownership and risk transfer immediately upon delivery, including door drop-off.
You are fully responsible for storage, handling, and consumption.
We are not responsible for:
• Lost or stolen orders
• Spoilage due to delayed refrigeration
• Incorrect delivery details
INSPECTION REQUIREMENT
You must inspect all meals immediately upon delivery.
Failure to report issues promptly may result in denial of any claim.
THIRD-PARTY SERVICES
We may use third-party providers including delivery services and payment processors.
We are not responsible for their actions, delays, failures, or omissions.
FOOD SAFETY & STORAGE
Meals must be refrigerated immediately.
Meals are delivered in insulated bags with ice packs, designed to help maintain temperature for up to 4 hours.
Consume within 3–4 days. Store at or below 40°F (4°C).
Failure to follow proper handling increases risk of illness.
AthleticsFit is not responsible for improper handling.
ALLERGY DISCLAIMER
We handle allergens including nuts, dairy, gluten, soy, and shellfish.
We do not guarantee absence of cross-contamination.
You:
• Must review ingredients
• Assume all allergy risks
HEALTH DISCLAIMER
Meals are for convenience only.
We do not provide medical advice. Consult a professional before dietary changes.
WEIGHT LOSS AND HEALTH CLAIMS
Results are not guaranteed.
We do not provide refunds based on outcomes.
Meals are not medically supervised.
We do not guarantee accuracy, completeness, or usefulness of nutritional information.
ORDERS, MODIFICATIONS & CANCELLATIONS
Changes must be made at least 48 hours before delivery.
PRICING & PAYMENTS
Prices may change at any time.
By placing an order (including phone, SMS, or email), you authorize AthleticsFit or its payment processor to charge you.
CHARGEBACKS & PAYMENT DISPUTES
You agree not to initiate chargebacks without contacting us first.
If violated, we may:
• Dispute the chargeback
• Suspend your account
• Refuse service
• Recover associated fees, costs, and damages
Fraudulent chargebacks may result in legal action.
USER ACCOUNTS
You are responsible for your account.
We may suspend or terminate accounts at any time.
PUSH NOTIFICATIONS & SMS
You consent to receive communications including transactional and marketing messages.
You may opt out of marketing messages at any time by sending STOP to our number.
INTELLECTUAL PROPERTY
Except for user-submitted content, AthleticsFit owns or licenses the content, software, branding, and intellectual property associated with the Services. Unauthorized use is prohibited.
USER CONTENT
You retain ownership of content you submit, including food photographs and nutrition records.
You grant AthleticsFit a non-exclusive, worldwide, royalty-free license to store, process, analyze, and use submitted content as reasonably necessary to provide, operate, secure, maintain, and improve our Services, including through third-party AI providers, subject to our Privacy Policy and applicable law.
You may request deletion of eligible personal information in accordance with our Privacy Policy and applicable legal requirements.
AI NUTRITION TRACKER & WELLNESS FEATURES
The AI Nutrition Tracker provides food recognition, nutritional estimates, calorie and macronutrient tracking, weight management goals, and activity tracking using third-party AI services, established calculation methods, and user-provided information.
1.AGE REQUIREMENT
The AI Nutrition Tracker is intended exclusively for users aged 18 or older. By accessing or using it, you represent and warrant that you are at least 18 years old. Users under 18 are not authorized to use this feature.
2.AI ACCURACY & NUTRITIONAL ESTIMATES
All AI-generated information, including food identification, ingredients, portions, calories, and macronutrients, consists of estimates and may be inaccurate, incomplete, or incorrect.
Information labeled "Verified" may be based on recipe records, product information, or AI-extracted nutrition labels and does not guarantee accuracy, independent certification, or allergen safety.
You are responsible for independently verifying nutritional information, ingredients, and allergens.
3.CALORIE GOALS & WEIGHT MANAGEMENT
Calorie budgets, energy expenditure, and weight management goals are calculated using established mathematical formulas and estimates, not individualized medical assessments.
Calculated goals may be unsuitable for certain individuals. Safety warnings are informational only, and the ability to save a goal does not mean it is safe or medically appropriate.
AthleticsFit does not guarantee the accuracy, safety, effectiveness, or results of any calculated goal.
4.HEALTH DISCLAIMER
The Nutrition Tracker is for general wellness and informational purposes only. It does not provide medical advice, diagnosis, treatment, or professional dietetic services.
Do not rely on the Nutrition Tracker for medical conditions, allergies, or medically supervised diets. Consult a qualified healthcare professional before making significant dietary changes.
5.THIRD-PARTY SERVICES & USER DATA
The Nutrition Tracker may use third-party AI providers and authorized integrations with Apple Health, Google Health Connect, or similar services.
Third-party data and AI results may contain errors or experience interruptions.
Food photographs, AI requests, responses, and related records may be stored and analyzed to operate, evaluate, and improve the Nutrition Tracker, as described in our Privacy Policy.
6.NO GUARANTEES & ASSUMPTION OF RISK
AthleticsFit makes no guarantees regarding nutritional accuracy, weight loss, health improvements, or other results.
You use the Nutrition Tracker and rely on its information at your own risk, to the maximum extent permitted by applicable law.
Nothing in this section limits rights or liability that cannot lawfully be limited.
DISCLAIMERS OF WARRANTIES
ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”.
WE DISCLAIM ALL WARRANTIES INCLUDING:
• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY
WE DO NOT GUARANTEE:
• ERROR-FREE SERVICE
• SECURITY
• RESULTS
YOU USE SERVICES AT YOUR OWN RISK.
LIMITATION OF LIABILITY
YOU EXPRESSLY AGREE THAT YOU USE ATHLETICSFIT SERVICES AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATHLETICSFIT, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION:
• LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
• LOSS OF DATA, LOSS OF USE, OR BUSINESS INTERRUPTION
• PERSONAL INJURY, HEALTH-RELATED CLAIMS, OR MEDICAL EXPENSES
• FOODBORNE ILLNESS, ALLERGIC REACTIONS, OR DIETARY OUTCOMES
• SPOILAGE, CONTAMINATION, OR DAMAGE DUE TO DELIVERY OR STORAGE CONDITIONS
• THEFT, LOSS, OR UNAUTHORIZED ACCESS TO DELIVERED ORDERS
• DELIVERY DELAYS, MISSED DELIVERIES, OR FAILED DELIVERY ATTEMPTS
• ERRORS, OMISSIONS, OR INACCURACIES IN MENU, INGREDIENT, OR NUTRITIONAL INFORMATION
• ERRORS OR INACCURACIES IN AI-GENERATED CONTENT, FOOD RECOGNITION, NUTRITIONAL ESTIMATES, CALORIE GOALS, ACTIVITY DATA, OR DECISIONS MADE IN RELIANCE ON SUCH INFORMATION.
WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND EVEN IF ATHLETICSFIT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATHLETICSFIT SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO:
• YOUR USE OR INABILITY TO USE THE SERVICES
• YOUR FAILURE TO PROPERLY HANDLE, STORE, OR CONSUME FOOD
• YOUR FAILURE TO BE AVAILABLE FOR DELIVERY
• INCORRECT OR INCOMPLETE INFORMATION PROVIDED BY YOU
• ACTIONS OR FAILURES OF THIRD-PARTY SERVICE PROVIDERS
• UNAUTHORIZED ACCESS TO OR USE OF YOUR ACCOUNT
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
FOR FOOD ORDERS, ATHLETICSFIT'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.
FOR CLAIMS ARISING SOLELY FROM THE AI NUTRITION TRACKER OR OTHER DIGITAL WELLNESS FEATURES, ATHLETICSFIT'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT PAID SPECIFICALLY FOR SUCH DIGITAL FEATURES DURING THE PRECEDING THREE MONTHS.
NOTHING HEREIN EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
THIS LIMITATION APPLIES REGARDLESS OF THE FORM OF ACTION, NUMBER OF CLAIMS, OR FORESEEABILITY OF DAMAGES, AND EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
YOU ACKNOWLEDGE THAT PRICING REFLECTS THIS LIMITATION OF LIABILITY.
INDEMNIFICATION
You agree to indemnify and hold AthleticsFit harmless from any claims arising from:
• Your use of the services
• Your violation of these Terms
• Food handling, allergies, or consumption
RELEASE & WAIVER
You waive all claims related to:
• Food consumption
• Allergies
• Foodborne illness
• Delivery issues
LEGAL PROTECTION, LIABILITY & DISPUTE RESOLUTION
In the event of any conflict, this section shall prevail.
All disputes shall be resolved through binding individual arbitration in Miami-Dade County, Florida.
You waive:
• Jury trial
• Class actions
We are not responsible for indirect damages.
We are not responsible for events beyond our control.
We reserve the right to refuse service at any time.
